Ticketed While Visiting Miami?

If you are visiting our city from out of state, you need to realize that Florida has slightly different traffic rules than other states. If you are charged with a traffic ticket or moving citation in Florida, you cannot simply ignore the ticket. The Miami-Dade County Clerk of Court states that a court hearing will be held to determine if a violation has been committed. If you are found guilty, the court may impose a civil penalty up to $500.00 or require attendance at traffic school, or both. If your violation involved a death or speeding in a school or construction zone, you may be fined up to $1,000.

You may think that you leave behind your traffic ticket when you return to your home state, but the state of Florida cooperates with other states in the reporting of traffic violations. Thanks to a cross-reporting system called the Driver License Agreement, a traffic violation in another state can result in increases in your car insurance premiums. It is important to pay the ticket promptly so that it doesn't appear as an unpaid ticket and so that you don't have to appear in Miami court and incur additional travel costs.

If you feel that your ticket was undeserved, a Miami traffic ticket attorney from our firm can aggressively defend your side of the story in court.
Miami-Dade County Issues over 300,000 Traffic Tickets Every Year

According to a 2004 report by the Florida Driver's Association, Miami-Dade County issued 374,332 traffic tickets for moving infractions in 2004. Almost one-third of the tickets were for speeding, and the second most common moving infraction was for careless driving. These tickets are being issued by the three primary law-enforcement agencies throughout the County: City Police, Sheriff Officers and Florida Highway Patrol. Out of the three, the City Police wrote the majority of traffic tickets.

The number of moving traffic tickets and citations that are given in Miami-Dade County are increasing every year. The Florida Highway Patrol announced this month that they are enacting an education and enforcement campaign to ticket aggressive truck and car drivers. This action is based on the fact that 88% of crashes involving cars and commercial trucks are caused by the actions of drivers. A mere 12% of these crashes are the result of road conditions, bad weather conditions or vehicle defects.

In an effort to keep the roadways safe, the Florida Highway Patrol will be on the lookout for violations attributed to aggressive driving. These may include following another driver too closely, making unsafe lane changes and speeding. If you are a driver in Miami-Dade County, you need to be extra careful to practice safe driving habits. When you are given a citation for reckless or aggressive driving, contact a Miami traffic ticket attorney to learn how you can challenge your charges and protect your rights.

Reckless driving is a criminal traffic infraction in the state of Florida, and carries the possibility of probation, jail time, community service, a stiff fine and much more. Before you appear in court, enlist the help of a talented

When will the 595 Construction End?

When will the Traffic on Interstate 595 ever end? Each and everyday traffic is magnified by the on-going constuction. In addition there is guaranteed to be an accident each and every day. As i listen to the radio to and from work I always hear about an accident on 595 right around University drive where the construction and traffic are most rampant.

This leaves many of us asking, is anything even going to be different after its all said and done?

Well it acutally is. Due to Florida's wet and clammy weather, swerving and weaving has always been an issue especially while on the enter and exit ramps. In an effort to increase drivier safety, the Florida Highway Commision has made these ramps braided. This will drastically cut down on accidents as many of them happen on the ramps.

As Florida does its best to make our roads safer, so should its drivers. Its very important to be careful as we drive especially in inclement weather, we need to slow down and be aware of whats ahead of us as its very difficult to stop on these slippery, hot surfaces. So remember drive safe, but if you make a mistake don't hesitate to contact Daniel Schulefand, your Florida Traffic Lawyer.

Beware of the Blind Spot

Traffic patterns shift at a moments notice, and with these changes come a whole heap of new things that drivers must be in tune with. In Florida especially, driving is notoriously fraught with the state's own unique laws. If you're operating a motor vehicle in the Sunshine State, you have to be consious of the climate's impact on driving conditions. Afternoon showers always impact the the roads as well as visibility. Wild-life is an ever present concern in swampy areas. The highway system has many unlit areas with heavy freight traffic. Every situation is unique so being continuously aware of your blind spot - the area of the road that is out of your line of vision - is especially critical. Every car and every driver also has its own unique blind spot so you have to consider how that will impact your travel.

There's another Blind Spot that Florida Drivers need to consider, and this one may be new to you. In Florida when you recieve a traffic citation or speeding ticket , are you always aware of how the ticket or citation will impact your license? The fine is only the tip of the iceberg, and many drivers don't realize that even if you pay each and every fine the points towards your license still remain. That's right, just because you clear the charge, you can't avoid the points, that stay on your record for a year, and have the tenency to increase insurance rates.

This Blind Spot can really end up hurting you, so its best to consult a Floirda Traffic Lawyer to help you avoid costly fines and make sure your record stays in tact.

Many drivers take great pride in knowing various routes to get the same destination. You'll ask for directions somewhere and they'll say, "go this way, I promise its the fastest". Although their route may be the fastest, or the shortest distance people often ignore the clock, and quite often the time is our best compass. Paying attention to the time will help improve your driving in so many different ways. For one you'll avoid crowded, exhausted routes which takes time away from any given day. In addition paying attention to the time combined with listening to the news to hear the traffic will help to avoid accidents as well as areas that are prone to wrecks.

For all of those fast drivers out there, the last thing they are looking to do is sit in bumper to bumper for an hour. So say rather than take I-595 they can opt to take Sunrise Ave or Broward Ave, although there are lights they are the quickest routes running east to west and vice versa from Ft. Lauderdale to I-75. Avoiding a heavy rush hour route such as I-595 will greatly decrease the likelihood of an accident. The last thing anybody wants is to crash, but even more so when it comes to rear-ending someone. Rear-Ending someone will not only get you a ticket for Reckless Driving, a banged up car but it will also get you a dreaded increase on your insurance rates. As far as your driver license goes that time spent accelerating due to a lack of patience combined with frustration could result in points on your record. Now say this driver opted to take Broward Avenue, not only would there be less people on the road, and no construction, but Broward has the least number of lights in comparison to Sunrise and Oakland Park.

People often take driving for granted and just view it as a uniform means for transportation. But what if everybody took a step backwards and got a little educated on the roads they utilize most everyday. If everyone took a little time to notice traffic trends including construction zones, they could very well decrease they're chances of getting in accidents and running into traffic. Each time you are on a road whether or not its crowded take a look at your watch and link the amount of traffic to the time of day. After you log the time, think about alternative routes that pose less of a threat. Think of traffic as a catalyst to more dangerous and costly traffic incidents.

Take for example, I live in Sunrise and I need to get to an appointment on Oakland Park and A1A. My appointment is at 6:30 pm on a Tuesday night. In the past I have gone straight down Oakland Park and sat in traffic and I noticed that there are quite a few lights. Keeping this in mind, I now think about alternative routes, I think about I-595 but notice that its 5:45 pm and in the thick of rush hour. I also realize that I-595 is too far south of my destination, so that route is out. I then mull over Broward and Sunrise, and think about Sunrise but I know theres a decent amount of traffic and once I get downtown I then have to head north. But having paid close attention to the routes I have taken in the past I realize that as you head East Broward Ave gets closer and closer to Oakland Park. I have now reached my decision, I will take Broward Avenue all the way East and then proceed north to get to my destination. By taking the time to choose my road carefully I not only avoid traffic but I avoid lights as well. So now it is less likely that I will get a ticket and get into a fender bender. As a result of avoiding those two issues, I will not get any points on my license nor will my insurance rates increase.

Even if you take the time to carefully plan your route theres still a very solid chance that you can run into some trouble. So if you happen to get caught up, don't fret over the situation, give your Florida Traffic Attorney a call and you can get back to your daily life without the added anxiety.

Gas prices, air fares and grocery bills are steadily rising. These reasons and more will keeps many Florida residents on the homefront this weekend. Compared to a year ago gas prices are on average one dollar more. In Broward County the average price of regular unleaded is about $3.95. The recent spikes have forced many Floridians to take trips closer to home, causing them to be more vulnerable to the police patrol increase, common on holiday weekends. As far as the airports go officials are claiming that they very well may reach a record traffic volume between thursday and tuesday. For example the Fort Lauderdale Airport is expecting almost 400,000 travelers in this time span. This would be somewhere around 80,000 passengers per day. This means that Traffic to, from and around West Palm, Ft. Lauderdale as well as Miami airports will yield dangerously slow traffic trends for quite sometime. So even those opting to take car trips will be subject to the effects from the high volume of travelers. This is an average of 40,000 more passengers than on a non-holiday weekends. The pre-conceived busiest travel days are said to be thursday and friday, so remember to get to the airport with plenty of time to spare. For example for flights within the U.S get there at least 2 hours prior to take off and for international flights plan on arriving at least 3 hours before. So those of you expecting to fly down I-595 right after work don't be so confident. Watch out for major delays and for those areas without traffic be keen to speed traps.
Officials at Palm Beach International are actually expecting a normal weekend since they claim that memorial is not a major holiday. Miami however is expecting an average of 15,000 more passengers this weekend, the highest expected volume of flyers still remains Fort Lauderdale-Hollywood. Miami however expects Saturday and Sunday to be abnormally hectic travel days. They're basing these numbers off of a speculative increase in cruise ship travelers. The good news is most construction zones will not be active this weekend, meaning no major speeding tickets with hefty fines and points. Luckily no doubling of points will occur, HAPPY HOLIDAY! But beware as seat belt tickets are being issued at an all time high. Remember something as simple as wearing your seatbelt can change an accident from resulting in death to a minor injury. So be smart, wear your belt and don't speed especially not on holiday weekends where there is increased traffic as well as police presence. Additionally the H.O.V lane is not subject to normal hours and regulations as this rule is void on major holidays including memorial day. But be aware of quick jerks and improper lane changes as these may very well result in citations or even worse, ACCIDENTS!!!!

Florida Court of Appeals calls Car Stereo Music Law Unconstitutional

A three judge panel of the 2nd District Court of Appeal in Lakeland, Florida. This was ruled on wednesday in response to two Pinellas County cases. Both drivers were accused of playing their car stereos too loudly. The panel found the law itself unconstitutional as it is only applicable to personal vehicles. Political vehicles as well as business vehicles are exempt from this law. The law states that a vehicles is in violation if its stereo is "plainly audible" from 25 feet or more away. The three judge panel deemed this law too vague for interpretation. The ruling has been transferred to the Florida Supreme Court for further review.

This demonstrates how significant this ruling is to public safety. Perhaps had the ruling not been so vague the court would have been able to recognize the possibility of severe danger. One circumstance for example would consist of an ambulance trying to get to the emergency room with a patient in critical condition after being involved in a motorcycle accident. However there is a car in front of ambulance that decides to move from the middle lane to the right lane, the very lane that the ambulance is in. As a result of loud music, the ambulance hits the car and not only is the cyclist injured further but now the driver of the car who moved out in front and the ambulance staff are injured as well. Now this is not necessarily likely to happen but if this law is phrased correctly and specifically enough it could prevent a tragic incident such as this from taking place. My hope is that this issue is handled by the Florida Supreme Court in a timely manner so that the repercussions from the temporary removal of this law are minimized.

Nowadays music systems have the potential of reaching extremely high volumes, so high that they could be clearly understood from hundreds of feet away. It should not be in the states interest to completely limit the use of these systems but there should be an effort to constitutionally limit the maximum volume of these stereos across the board. There should be no exemptions as business vehicles as well as political vehicles should be punished for violations.

Speeding in a Construction Zone - Doubled Up

In a state such as New York people do not rely as much on their personal cars as they do in Florida. New York has an in depth subway system within Manhattan as well as all surrounding boroughs. Trains and buses fill the city along with the infamous yellow taxi cabs. The Metro North Railroad spans from Grand Central Station in midtown, all the way up to Connecticut. The New Jersey Transit runs throughout the entire state of NJ and stops in Pennsylvania Station. The Long Island Railroad assists commuters residing throughout the entire island no matter where the location completing each route in Pennsylvania Station. And then of course theres the nation wide Amtrak, connecting people via train to various destinations north, south, east and west.

But lets face it Florida doesn't come close to offering the amount of public transportation that New York has, the state's trains are restricted to the Tri-Rail running from South Beach all the way up the East coast of Florida. Sure there are buses, but nowhere near the convenience of a centralized metropolitan area like New York City. So where do Florida residents turn? Well they all pretty much rely on their own cars for just about everything. When you have to depend on your car for all of your transportation the chances of getting a traffic ticket are significantly increased.

The legal ramifications for traffic offenses such as speeding, careless and reckless driving and driving with a suspended license are severe. Drivers found guilty can face ramifications of rising costs for insurance coverage, costly fines and even face a losing their driving privilege via D-6 Suspension. While the fines imposed for speeding are already high in the Miami Area, tack on a construction zone and the fines double. The traffic fines associated with construction zone violations near amounts close to a thousand dollars.

The good news about construction zones is that they are not operating 24 hours a day. So an officer cannot issue a speeding citation in a construction without the presence of workers at the site of the work and/or construction equipment. In order to be issued a traffic citation for speeding in a construction zone there must be ample warning before entering such as: notice of the new speed limit and a sign that states: "fines are doubled in construction zones". Now just because this is protocol does not in any way mean that officers don't issue tickets without these warnings. Be aware that construction can happen both on and next to the road.

Many people panic after receiving a speeding ticket in a construction zone, and they immediately zoom to the clerk's office or courthouse to pay it off without considering the damage it can do to their license. There is of course an increased penalty for speeding in a construction zone but in addition the amount of points are nearly doubled for each speeding interval. For example, being gunned down for speeding 1 to 9 mph costs $156.00 and 30 mph plus nears $1000.00 dollars. Each and every time you are issued a citation for a violation containing points, you make yourself vulnerable to increased auto insurance rates and even license suspension (D-6 Suspension).

3 DMV Employees Arrested in Broward County

This seems to have become a trend in South Florida as in Palm Beach 5 DMV employees were arrested for doing the same. At the conclusion of the article a Broward DMV supervisor stated: "The bottom line to our agency is we put a lot of time and effort training these folks and we are committed to ensuring the security and integrity of the driver's license issuance process." Now this has happened twice in a small timespan, is there any reason why this couldn't be happening throughout the state of Florida as well as any other state with high amounts of illegal immigrants. I guess for lack of a better term, who can you trust?

There was an apparent ring leader in this operation. Rolin Pierre was indicted once again last week for re-entering the country illegally after being deported twice before. The employees themselves face up to 15 years in prison on charges of producing a false driver's license and conspiracy to produce a false driver's license.

Say these were just fake IDs, you know the ones you buy on the street that actually do scan and can pass a real driver's license just as long as you don't present it to an officer of the law. The key difference here is that these people with no legitimate legal documents would actually be posted in the system as real, fullproof licensed drivers. This would make it realistic for them to get jobs in which they became listed as employees via W-2, as well as increase their chances of being accepted for social security. So this small local crime, is in turn a federal offense, and not only against the state of Florida. So why are the accused not being held on counts of conspiracy to commit fraud against the federal government?

Well you have to stick to facts of what you've got and what we have here lies within the state of Florida. The people who were trying to obtain the licenses were also indicted. Now couldn't this all have been different had the suspects gone through attorneys with the proper authority and means to obtain drivers licenses. Most attorneys these days realize that lump sums are a thing of the past. Many people cannot come up with the money to pay in full. So although it was in many ways cheaper for the accused to choose this illegal process, they could have just as easily hired an attorney and designed a payment plan.

Daniel Schulefand P.A. has the authority and capability to obtain drivers licenses for immigrants new to the country. In addition the Law Offices of Daniel Schulefand deals with the DMV on a daily basis, so you can 100% trust that he will make sure every document sent and received is completely legal and proper. We also construct payment schedules pursuant to our client's financial capabilities and preferences. There is no way of knowing if the legal action you submit is valid. Thats why so many people trust us with their traffic tickets, moving violations, DUI cases, citations, and license renewal and redemption.

School Zone Traffic Violations

School Zones are the everyday drivers worst nightmare. Many times its difficult to tell when one is going to pop up but for the most part people just don't pay close enough attention to the signs. Often times people are daydreaming and maintaining their normal speed and unintentionally violating the law. There are two main violations most commonly associated with school zones; speeding and passing a stopped school bus.

Speeding in a School Zone:

when entering a school zone there will be a sign with flashing lights

the speed limit will drop significantly (ex: 30mph will turn into 20mph or 15 mph)

points are doubled in school zones

fines are doubled in school zones

there is an unwritten law that its okay to stay within 10 mph of the speed limit without getting pulled over (fact or myth?)

if you are doing 40mph in a 30mph zone then a school pops up you're actually doing 40mph in a 20mph School Zone

if you get pulled over, not only will you be ticketed for speeding but in addition your ticket will say "speeding in a school zone"

its essentially like going 40mph over the speed limit.

your license will be penalized heavily in terms of points

you will be forced to pay escalated fines and fees

you may be required to go to driving school depending what types of violations you have committed in the past

so the dilemma is, how do I deal with these infractions?

Passing a Stopped School Bus

These days many jobs coincide with school hours, they begin early in the morning and they finish up just as the schools are letting out. People are exhausted from work and are just trying to make it home to catch their breath. Take for instance you're turning on your street doing the speed limit and just as you turn into your drive way you spot a police car behind you with it's lights on. At that point you see the bus behind you and realize you have just passed a stopped school bus.

passing a school bus while stopped is a 4 point infraction

these citations carry heavy fines and fees

they may impact your insurance rates if found guilty

you may already have a lot of points on your license and this could get your license suspended

dealing with a suspended license is a whole other issue see our blog post: http://bit.ly/kcEoy1

is it worth it to show up to court and take the legal and financial beating?

this traffic violation could be even more of a hassle if you pass a stopped bus in a school zone.

When it comes to dealing with traffic violations especially touchy ones such as school zone violations it best to trust a professional with proven results. Daniel Schulefand P.A will gladly give you a free, detailed consultation. When it comes your drivers license don't take anything lightly. Confide in you Miami Traffic Lawyer.

You got pulled over, and now you have a traffic ticket sitting on your desk. You look at the ticket, and:

Chances are the officer's handwriting is illegible

There are various groups of letters and numbers that mean nothing to you

You can't figure out how much you're going to have to pay

You wonder...When is this due? Where do I send it? Do I have to appear in court?

You worry about what this ticket will mean for your driver's license and insurance rates

So, you try calling the phone number on the ticket, and:

There's a long automated menu

You don't know which of the many options to choose

You enter the wrong numbers or have to start over

The ticket isn't in their system yet

You can't figure out how to speak to a real live person

What can you do now?

	1. Pay the large fines, and hope for the best

You can try to find out what you owe

Cut them a hefty check and hope for the best

Hope and pray that the violation was non-point bearing

	2. Do it without a traffic lawyer, and represent yourself in court

Begin the long, complicated search for where, when and what to bring

Miss an entire day of work

Blindly attempt to find your name on the extensive complex court docket

Spend hours looking for your time and room number, waiting for your case to be heard

Pretend you're familiar with courtroom etiquette

Give your best excuse the judge has heard hundreds of times

End up writing that same whopping check and accept the undesired points on your license

Make that discouraging drive home with less money, emotionally defeated, and fervently hoping you don't get pulled over again

 3. Let an expert take care of it

 Go to www.helpmewithmyticket.com
and click to instantly speak to an experienced professional

Let your Florida Traffic Attorney with over 20 years of experience handle the case for you

Get a phone call updating you on the status of your case

Stand a much higher chance of minimizing the penalties and fines

Drive on with confidence and get back to your life

So, in summary, while you could take matters in to your own hands, you should let Daniel Schulefand, a Traffic and Criminal Lawyer who has done this hundreds of thousands of times, get you great results.

the best party to have is the one in the comfort of your own home. Police commonly set up checkpoints in which they say they're just checking to see if you're wearing a seatbelt but as we all know its not to difficult to smell the scent of Black Label. DUIs are a criminal offense and for the most part people who get busted are not criminals. Does a criminal go over to friends with a bottle of wine for the couple and a new toy for the kids, i think not. If caught you'll need a ticket lawyer in miami. A criminal defense attorney who knows how to set you free from schooling, and license suspension. The worst thing to do is avoid the infraction and attempt to handle it yourself. Ask yourself would a shoplifter represent themselves in court? No way they were caught on camera just as you were caught with a high blood alcohol content. Many times we're able to turn it away and forget about it but when you strictly go through the courts there are fines and fees that you can easily avoid by hiring a ticket attorney. The last thing you want is to be issued a D-6 suspension and handle 2 separate cases. so call us for a free consultation and make sure your holiday fun has no consequences.
