Challenging a Speeding Ticket
In speeding tickets and other moving violations, the State of Florida counts on the fact that most people will plead guilty and simply pay the fine. But if you challenge the ticket, you will almost certainly pay a lower fine than you would if you had pled guilty, and receive fewer points on your driver’s license.
There are three basic ways used to identify speeders. Each offers one or more means for a successful defense.
Pacing – an officer in a vehicle paces your vehicle and through observation of the officer’s speedometer clocks the speed of your car. To prove its case, the State must present evidence that the officer’s speedometer was correctly calibrated.
Aircraft – an officer in an airplane clocks a vehicle’s speed using a stopwatch. The officer then relays the identity of your car to another officer on the ground who stops the vehicle. If you challenge the ticket, both officers must appear in court, which they can fail to do.
Radar Gun – an officer uses a radar device which calculates your speed. In court, the state must show that the radar device was in proper working order, and that the officer observed your vehicle speeding.
